It’s Not Enough to Only Problem Solve

Many believe, and rightfully so, that problem solving skills are the one “must have” on any job. It’s an important element in any employee’s productivity, but there are also other things that are just as crucial when an employee is solving problems.

As A. Harrison Barnes, Hound.com founder and career coach, explains, the way your employees interact with your customers as they’re looking for solutions can make or break the experience in its entirety – and can potentially either lose a customer forever or convince your customers that your company is the only game in town.

One example includes the story of a woman who’d called an electronics company to alert them to a potential safety hazard on one of its products. She says that while the customer service representative was polite and tried to be helpful, he came across as young, inexperienced and a bit too laid back, especially considering the concerns she had for one of the company’s best selling products. The representative began the conversation with, “So what is it I can make happen for you today?” Perfectly harmless, albeit not very professional. The woman continues with her experience, “He kept telling me that the company no longer made the surge protector I was referring to, but that he’d “go plunder around the warehouse” in an effort to find a replacement for her. Of course, she had no interest in a replacement, or for that matter, even a refund; rather, her goal was to alert the company of a potential liability.

While most companies want a certain procedure to be followed, it’s the delivery of that procedure that’s just as important as your message. Proper training, the ability to problem solve and a mature approach to your clientele are all what define a good experience. If any of these are absent, odds are, you’re risking your customers, says A. Harrison Barnes.

“It’s important new employees receive the proper training” says Barnes. “Further, it’s not uncommon for a company to hire an employee with a particular job in mind only to realize he thrives in another area”. If your customer service reps aren’t finding their rhythm, but are otherwise good employees, it’s always more advantageous to you and the employee (not to mention the customer) to place her in a position that’s better suited to her skillset so that you can put only those who thrive in customer interactions front and center to be the “voice” of your company.

Finally, the Hound.com founder says that a relaxed approach, but one that’s not absent any level of professionalism, is the balance you’re looking for. A bit of training and a commitment from your team is a solid foundation to build upon. Like the example above, you want those customers who provide feedback on your company’s services or products and the last thing you want is to discourage them from this kind of interaction. It’s that first interaction that’s so important – who’s taking their calls?

Make Those Last 5 Minutes Count

You survived the majority of the interview and it’s nearing its end. The interviewer has explained what the job entails, the salary, benefits and opportunities within the company. He’s taken a deep breath and said, “OK…so that’s it. That’s what I have. Do you have any questions?” He’s explained everything in detail, but you need to have a question ready, says A. Harrison Barnes, career coach and Hound.com founder. If for no other reason, that final question eases into the end of the interview than a choppy, “No…no questions here”. You want to ease into the obligatory “Thank you for your time and I look forward to hearing from you.” Try this, says the Hound.com founder:

Interviewer: OK. So, I think I’ve covered everything…let’s see…we’ve covered the hours, the qualifications I’m looking for and the job duties. So…do you have any final questions for me?

You: Yes, actually I do. You mentioned you’re currently running ABC Software. I recently completed a course through the junior college and I’m familiar with the very latest version. Did you say the company was working with version 6?

Interviewer: Yes, I know it’s the release that came out a few months ago. Is that the one you’re referring to?

You: Yes, it’s the one with the new and updated tracking capabilities.

You’ve instantly reminded the interviewer that you don’t have to be trained on the company’s computer programs and that you’re up to date with the latest versions…and, most importantly, says A. Harrison Barnes, it’s the closing line that you’re leaving him with. At this point, the interview can come to a close:

Interviewer: That’s great to know. We really weren’t looking forward to the training curve. Your knowledge of it will actually lift a burden off of our accounting department.

You: I hope I get the opportunity to put those skills to use. I really appreciate your time and if there’s anything else I can provide as you make your decision, please just let me know. I’m more than happy to do whatever I can.

At this point, you’re both probably standing; you shake hands and you’ve just taken what is sometimes the awkward last few minutes of an interview and made them into the most important and most memorable aspect of his time spent with you. You walk out the door, he puts a big star in the top corner of your resume that’s still on his desk and he calls in his secretary to bring your resume to the personnel department.

Whatever your “final question” is, ideally, you’ll have one at the ready. Whether it’s poised as a reminder of your strong skills outlined above or if he has his degree on his office wall and you find that in common, your goal is to finish strong. Believe it or not, says the Hound.com founder, the ability to make that happen has earned as many job offerings as anything else. Employers want those employees who are confident and who can assert themselves. You need to be the one to make that happen.

Why Conferences are Important

Many lawyers believe in the power of legal conferences.  It’s where they can get their first glimpses of the new legal trends, they can network and they can also take the economic pulse of the legal community as a whole.  A. Few folks are aware there are sometimes legal considerations when leaving their employer to go to work for the competition. In fact, the laws differ from state to state. For instance, if you’re a California resident, you can start your own business that competes with an employer you just left – and you can go after those clients you once worked with while employed with your new competition. You can be sure that protective mechanisms are in place with your employer that will alert the right leaders when something’s not quite right. Are Law Schools Doing Enough to Incorporate Domestic Violence Legal Issues in their Curricula?

Most of us by now have heard at least one of the terrifying tapes allegedly made by the award winning actor, Mel Gibson to his girlfriend. He has been accused of beating Oksana Grigorieva and chipping her teeth. His rants are dehumanizing and brutal. It should be noted these are all alleged at this point and neither Gibson nor his attorney have conceded authenticity or accuracy of any of the recordings. If nothing else, these tapes and Gibson’s questionable behavior, which is not in dispute as it has been documented via several media outlets, put the spotlight on domestic violence in this country yet again. A. Harrison Barnes, lawyer and career coach, and also the founder of LegalAuthority.com, says this has been an important, yet not always effectively addressed, crisis for several years. This led us to wonder: are law schools preparing new lawyers to represent the victims of spousal or domestic abuse? After speaking with the LegalAuthority.com founder, it was clear the proverbial ball was being dropped.

Despite many who say domestic violence rates are declining as a whole in this country, nearly every state is reporting increases in 911 calls requesting assistance due to violence within the home and indeed, domestic violence is being sought more in divorce cases than ever before. Intimate partner homicides are on the rise and in Oklahoma, Renee Brewer, the Executive Director of the Native Alliance Against Violence says the “statistics are only getting worse…Oklahoma is on track to be the state with the most domestic violence related homicides in the country”.

Is better educating those in the legal community, such as lawyers, paralegals and detectives, the key? The Department of Justice says it is, and A. Harrison Barnes agrees. Judges and other legal professionals who are uninformed about these violent issues can endanger the safety of victims, says one DOJ report released in late 2008. The report continues, “One need is to alert lawyers to the ways in which domestic violence issues crop up in seemingly unrelated fields of law…lawyers who practice any kind of family, criminal, tort, financial or poverty law are likely to have cases complicated by domestic violence”.

This, says Barnes, is just the tip of the iceberg. It’s important for lawyers to be able to identify victims or signs that a client is being abused. While he’s quick to point out the responsibility should never rest solely on one outsider’s shoulders; understanding the psyche of an abuse victim is like turning on a light switch. Once you’ve witnessed it, you’re likely to always know it when you see it.

Many law schools are now beginning to shift their stances and have begun the transition towards the inclusion of this important social issue in their respective curricula. Some are offering courses that address the dynamics of the abuser, the abused and the cycle of abuse while others are discussing the “dynamics of domestic violence and civil and criminal litigation on behalf of battered women”.

Clearly, there’s much work to be done and will take time, but Barnes says keeping the focus on this important issue is key.

Monday, Monday

How do you deal with the Monday blues? Employees have historically dreaded the Monday morning commute. They’re jarred out of their more laid back psyches from the weekend and often, they know the week ahead is going to be challenging, at best, says LegalAuthority.com founder A. Harrison Barnes. For attorneys, they’re often faced with showing up to a court hearing on time and fully prepared.

Mondays also mean we have to readjust once again to the same old grind (unless, of course, you love your job and then it’s anything but unpleasant). Most of us, though, can absolutely relate to dreading those pesky alarm clocks on Monday mornings. Before you chalk it up to human nature, A. Harrison Barnes has a few tips to offer:

  • Usually, the worst part of a Monday is knowing you left things undone on Friday evenings. You can ease some of that sense of urgency by closing the loose ends before heading out Friday night. It might take an additional fifteen or twenty minutes, but your weekend will be much better if that’s not nagging you in the back of your mind.
  • Get there early. Another frustration is not allowing yourself a few minutes after arriving at the office to catch your breath, have a cup of coffee and check emails. When you’re rushed, it only adds to the aggravation level.
  • Brown bag your lunches on Mondays. Again, this is just another way to take a step back, catch your breath and prepare for what follows Monday mornings – which is Monday afternoons, of course.
  • Don’t schedule meetings if at all possible. It doesn’t matter if we’ve been in the same job for twenty years, you never get over the resentment you feel for Monday morning staff meetings. Save them for Tuesday or better still, Thursday.
  • If you’re travelling, encourage the company’s travel department to schedule your flights later into the afternoon. For one thing, if you’re flying out early Monday morning, you’re going to be scrambling at 3 a.m. to get to the airport on time. If your flight is scheduled for early afternoon, you’ll spend a few hours at the office pulling your hair out with last minute details that need your attention.

These are just a few of the ways you can make your manic Mondays a bit easier to tolerate. The LegalAuthority.com founder offers one final suggestion: make Mondays your telecommute day if possible. Not all companies allow their employees to take advantage of this perk yet, but there is definitely a shift towards this trend.

Troubling News for the Legal Sector

In June, the Bureau of Labor Statistics reported in its preliminary findings that three hundred legal jobs had been added during the month of May.  In July, those numbers changed as the final tallies were released.  Turns out, the true number reveals a loss of six hundred jobs in the legal sector.  With May and now June’s preliminary numbers, close to four thousand jobs have been cut.  A. Harrison Barnes, attorney and LawCrossing.com founder, says this brings the total number for the past year to more than 22,000 job losses in this field alone.  Paralegals, legal secretaries and lawyers make up these numbers.  Further, these cuts are being felt in every region of the country.

The numbers can be confusing, especially when it seems one report or set of statistics contradicts others, says the LawCrossing.com founder, but there are many factors that go into the formulas.  For instance, BLS reports a national unemployment rate of 9.5%, down two tenths of a percent from May.  But there were more than 400,000 jobs cut due to the temporary census workers who’d wrapped up their jobs.  While the numbers can be confusing and the formulas used to calculate them even more confusing, the total picture doesn’t appear to be improving as much as Americans had hoped. The startling numbers just from the legal sector is proof things are not nearly as good as many had hoped.

Even the seemingly good news regarding the traditional jump in seasonal employment is threatened, says A. Harrison Barnes.  Typically, close to 28,000 jobs are added in the hospitality, amusement, gambling and recreation sectors; however, with the Gulf Coast region feeling major declines in the number of vacationers, it appears these numbers will need to be adjusted as well.  Many businesses in this region of the country reported their big moneymaker of the year, traditional 4th of July celebrations, were way down over the long weekend.  One vendor along Biloxi Beach said his equipment, including boats and law chairs, are traditionally rented out in the summer months by 9 a.m. each day.  The holiday weekend revealed more than 85% of his equipment not being used.

Whether or not the drastic reduction in the legal sector is indicative of a fluke remains to be seen; however, it should be noted in May, 2008, the American legal sector saw a loss of 1,100 jobs.  Still, many believed those months of such drastic drops were over.  The national employment level then was at 5.5%.  Economists and other experts were already panicking because it was the highest unemployment numbers in more than two decades.

Less than one percent of working American adults consider themselves employed within the legal sector; clearly, that statistic might see a big drop in the coming weeks and months.
